    About This Episode:

    We trace the history of the right to keep and bear arms from English law in the 1300s through modern U.S. Supreme Court cases. We discuss the Statute of Northampton, the Stuart era, the English Bill of Rights, and how these developments shaped American constitutional thinking and the Second Amendment.

    We then cover the colonial period, the Revolution, and post-Civil War developments, including restrictions on enslaved Black people, the Black Codes, the 14th Amendment, and cases such as Dred Scott, Cruikshank, and Miller. We end with major modern laws and decisions, including the NFA, the Gun Control Act, FOPA, Heller, McDonald, Bruen, and Rahimi, as well as current cases involving AR-15 bans and magazine limits.

    In this episode we give a roundup of current Second Amendment court cases and gun-law developments. We discuss the Supreme Court’s narrow ruling in the Hemani case, the Court declining to hear two New York cases for now, and the 6-3 decision in Wolford v. Lopez striking down Hawaii’s private-property carry rule.

    We also cover new lawsuits in California and Michigan challenging carry and permit restrictions, as well as Virginia’s new law banning certain assault firearms and magazines over 15 rounds. We note that several related cases are still pending in the courts.

    We look back at the events leading to the American Revolution, focusing on British attempts to control arms and ammunition and the growing tensions caused by taxation, the Boston Tea Party, and the Coercive Acts. We cover General Thomas Gage’s actions in Massachusetts, the powder alarm of September 1774, and how quickly the militia responded when British authority moved against stored powder.

    We then discuss Lexington and Concord on April 19, 1775, including Paul Revere’s warning, the fighting at Lexington Green, and the British retreat to Boston under attack. We also touch on the siege of Boston, the Battle of Bunker Hill, and the arrival of George Washington and Henry Knox, linking these events to the founders’ view of an armed population as a check on tyranny.
